Terms of Service

These terms govern your use of Gratitude ("we", "us"), a service that helps recruiters write and improve post-interview thank-you emails. By creating an account or using the service you agree to these terms and to our Privacy Policy. If you use the service for an organization, you agree on its behalf and confirm you are authorized to do so.

Eligibility

You must be at least 18 years old and able to form a binding contract to use the service.

Your account

Keep your sign-in credentials secure and tell us promptly about any unauthorized use. You are responsible for activity under your account. Organization admins control membership, billing, and shared settings for their organization.

Your content

• You keep ownership of the information you enter and the emails generated for you. You give us permission to store and process that content only as needed to provide and improve the service.
• You confirm you have the right to share any candidate, interviewer, or company information you enter, and that doing so complies with the law and any obligations you owe to others.
• Do not enter sensitive information the email doesn't need, such as ID numbers or health details.

AI-generated content

Emails are drafted and reviewed by AI and may contain mistakes, including wrong names or details. Review every email before it is sent. You are responsible for what is sent, and we are not responsible for hiring outcomes or decisions made based on generated content.

Acceptable use

Do not use the service to:

• break the law or infringe anyone's rights;
• create misleading, harassing, or discriminatory content;
• interfere with the service, get around plan limits, or access other customers' data;
• resell the service or build a competing product using it.

We may suspend or close accounts that violate these terms.

Plans, billing, and cancellation

• Paid plans are billed monthly in advance through our payment processor and renew automatically until cancelled.
• You can cancel at any time from your account or organization billing settings. Cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable.
• Monthly email allowances reset each calendar month (UTC) and do not roll over.
• We may change prices with at least 30 days' notice; changes apply from your next billing period.

Service changes and availability

We may change, add, or remove features. We aim to keep the service available but do not guarantee it will be uninterrupted or error-free.

Termination

You can stop using the service and close your account at any time. We may suspend or end access for violations of these terms or if required by law. After termination we may delete your content as described in the Privacy Policy.

Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent allowed by law.

Limitation of liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business opportunities. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose.

Indemnity

You agree to defend and hold us harmless from claims arising from content you enter, emails you send, or your violation of these terms or the law.

Governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes will be resolved exclusively in the state and federal courts located in New York County, New York, and you consent to their jurisdiction.

Changes to these terms

We may update these terms. We will post changes here and update the effective date, and will notify you of significant changes. Continuing to use the service after changes take effect means you accept them.
